Refunds & right of withdrawal

Short version: if the eSIM has not been activated and no data has been used, you get your money back. Once it is running, you do not. Everything below is the detail behind those two sentences.

1. The 14-day right of withdrawal, and why it usually does not survive checkout

An eSIM plan is digital content supplied without a physical medium. Under Spanish consumer law (art. 102 and art. 103.m of the consumer act, RDL 1/2007) you normally have 14 days to change your mind — but that right is lost when three things are all true:

  1. you expressly asked for the content to be supplied immediately,
  2. you expressly acknowledged that this loses you the right of withdrawal, and
  3. delivery has actually started.

That is why the order form asks you to tick a box before paying. Ticking it is what makes instant delivery possible: we send the eSIM in seconds instead of holding your order for 14 days. If you have not been delivered an eSIM, the right is untouched and you can simply withdraw — write to us within 14 days of the purchase.

2. What we refund anyway

Beyond the strict legal minimum, we refund in these cases. You do not have to argue for it.

Unspent wallet balance Full, as long as the balance still covers the top-up you want back (see §4).

3. What we do not refund

A top-up is a prepayment, not a purchase. While the money is still sitting unspent in your balance you can ask for it back and we return it to the card it came from. The condition is simply that the balance has not been spent: if you topped up $50 and your balance is now $12, that $50 has become eSIMs you already hold, and it is those rules — not this section — that apply.

5. How to ask

Write to support@smoozygo.es (Smoozy Go) or support@krahs.app (KRAHS eSIM) with your order reference — it looks like SG-1A2B3C4D or KR-1A2B3C4D and is on your order page and in the delivery email. Tell us what happened. No form to fill in, and you do not need an account.

You can also use the model withdrawal form in the annex of the Spanish consumer act, but an email saying you withdraw is enough.

6. How the money comes back

CardTo the same card, through Stripe. We cannot send it anywhere else. We start it within 14 days of accepting the refund, and normally the same day. Your bank then takes its own time — usually 5–10 working days.
Wallet balanceTo your wallet balance, immediately. At once. From there it is spendable in both stores, or refundable to the card under §4.
Crypto (KRAHS eSIM) To a wallet address you give us. We do not keep your address and cannot recover it from the payment. Manually, by a person, after you send the address. This is the one route that is not automatic — it is the trade-off for paying without identifying yourself.

You never lose money on the refund itself: we return the amount you were charged, in the currency you were charged in. If your bank applies its own conversion between the payment and the refund, that difference is the bank's and is outside our reach.

7. Before you call your bank

If something is wrong, an email to us is faster than a chargeback and does not put your account under a fraud review. We answer. If we are at fault we say so and pay.

8. Your statutory rights

This page is what we commit to, and it is more generous than the legal minimum for digital content. It does not reduce any right you have under Spanish law (RDL 1/2007) or, if you live elsewhere in the EU, under the mandatory consumer law of your own country. Where this page and the law disagree, the law wins.
